1. Introduction
Welcome to eRideList, trading as eRideList (ABN 14218299030), registered as ERIDELIST (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your use of our website, mobile app, and services (collectively, the “Platform”), which facilitates transactions and services for acceptable items, including erides, electric vehicles (EVs), and hybrid EVs, exclusively for Australian consumers. The Platform is built on a website platform with a classifieds theme, hosted by Hostinger in Singapore, and integrates third-party services such as Facebook, Google, and Twilio. By accessing or using the Platform, you agree to these Terms and all applicable Australian laws, including the Privacy Act 1988 (Cth) and Australian Consumer Law (ACL). If you do not agree, you must not use the Platform.
We may update these Terms at any time, with changes effective upon posting on the Platform. Continued use after updates constitutes acceptance. For questions, contact us via the

2. Definitions
For clarity, the following terms are used in these Terms:
- Platform: eRideList’s website, mobile app, and services for transactions and services related to acceptable items.
- User: Any individual or entity using the Platform, including buyers, sellers, renters, service providers, or visitors.
- Owner: A User listing acceptable items for sale or rent.
- Renter/Buyer: A User renting or purchasing acceptable items.
- Service Provider: A User offering servicing, repairs, part replacements, or maintenance for acceptable items.
- erides: Personal mobility devices powered by electric batteries, designed to be ridden by a person (child or adult). Examples include e-bikes, e-scooters, e-skateboards, and one-wheelers. Non-rideable devices, such as remote-controlled toys, are not permitted.
- Electric Vehicles (EVs): Road vehicles powered entirely by electric batteries, designed to be driven by a person. Examples include fully electric cars (e.g., Tesla Model 3, Nissan Leaf) and vans. Non-drivable vehicles, such as remote-controlled racing cars, are not permitted.
- Hybrid EVs: Road vehicles combining an electric battery and motor with an internal combustion engine, designed to be driven by a person. Examples include plug-in hybrids (e.g., Mitsubishi Outlander PHEV) and non-plug-in hybrids (e.g., Toyota Prius). Non-drivable vehicles are not permitted.
- Acceptable Items: Items meeting the definitions of erides, EVs, or Hybrid EVs, which are the only items permitted for listing on the Platform.
- EV Services: Servicing, repairs, part replacements, or maintenance of acceptable items, including battery maintenance and software updates, offered by Service Providers.
3. Platform Use
eRideList is a free platform enabling Australian Users to list and search for acceptable items (erides, EVs, Hybrid EVs) and EV Services within their local area (e.g., state or city). We facilitate listing, searching, and communication, using services like Google Maps APIs for location-based searches, Facebook and Google for login authentication, Twilio for phone verification, and Google reCAPTCHA for spam prevention. We do not own, sell, rent, or service acceptable items, process payments, or handle deposits. Users arrange transactions and EV Services directly and engage at their own risk.
All listings are reviewed within 24 hours to ensure compliance with the definitions of acceptable items. Non-compliant listings (e.g., non-electric vehicles, non-rideable/drivable items) may be removed without notice. For guidance, see our Common Scams and Fake Trades at

Users may communicate through Platform tools or directly (e.g., phone, email) at their discretion. All communication, transactions, and EV Services, whether on or off the Platform, are at Users’ own risk. eRideList is not responsible for any issues arising from such interactions, including the condition, safety, legality, or quality of acceptable items or EV Services (e.g., battery health, compliance with Australian standards).
4. Prohibited Activities
Users must not:
- List illegal acceptable items or EV Services (e.g., stolen items, non-compliant or unroadworthy items, unlicensed repairs).
- Misrepresent the condition, battery health, ownership, availability, or EV Service qualifications of acceptable items.
- Engage in fraudulent transactions or EV Services.
- Harass others or engage in discriminatory conduct under Australian law (e.g., Sex Discrimination Act 1984 (Cth)).
- List hazardous or restricted acceptable items or EV Services (e.g., non-compliant batteries, unsafe repairs, items exceeding legal power limits under Australian Design Rules).
- Breach cybersecurity (e.g., hacking, data scraping).
Violations may result in listing removal, account suspension, or legal reporting. Report issues via the

5. User Accounts
5.1 Eligibility
Users must be at least 16 years old. Users under 18 renting, buying, or arranging EV Services for acceptable items requiring a licence (e.g., certain EVs or Hybrid EVs under Australian road laws) must hold a valid Australian driver’s licence or learner’s permit, or have parental/guardian consent for acceptable items or EV Services not requiring a licence (e.g., erides, battery maintenance). By creating an account, you confirm you meet these requirements. Accounts of ineligible users will be terminated.
5.2 Registration
To list or contact other Users, create an account with accurate, current information, using authentication services like Facebook, Google, or Twilio. You are responsible for account confidentiality and must notify us of unauthorised use via the
Contact Us form. We may suspend or terminate accounts for false information or violations of these Terms.
5.3 Communications
By registering, you consent to electronic communications (e.g., account updates, ad approvals). Opting out may limit Platform functionality. We use industry-standard security, including encryption via Hostinger, but cannot guarantee 100% data safety.
5.4 Reviews
Users may leave honest reviews after transactions or EV Services. Reviews must be fair, respectful, and relevant, per our March 2025 honesty guidelines. We moderate reviews and may remove those violating guidelines. By submitting a review, you grant us a royalty-free licence to use it for Platform promotion.
6. Transactions and EV Services for Acceptable Items
6.1 Listing Acceptable Items and EV Services
Owners and Service Providers must ensure acceptable items are safe, functional, and legally compliant (e.g., roadworthy if required under state laws, compliant with Australian standards for battery safety and power output) and that EV Services are performed competently and legally (e.g., by licensed technicians if mandated). Listings must include accurate descriptions, photos, and location details (e.g., city or state), including battery condition and range, as encouraged in our March 2025 honesty note. Users grant us a royalty-free licence to use listing content for promotion. Misrepresentations may lead to listing removal or account suspension.
6.2 Transactions and EV Services
Users arrange sales, rentals, or EV Services directly within their local area, including payments, deposits, or cancellations, outside the Platform. These are agreements between Users; eRideList is not a party to them. Renters must return acceptable items on time and in the same condition, including battery charge level. Buyers should verify the condition of acceptable items, including battery health and compliance, before purchase. Users arranging EV Services should confirm Service Provider qualifications, especially for battery or software-related services. All parties are encouraged to document the condition of acceptable items or EV Service details with timestamped photos or records at transaction or service start and end.
6.3 Buyer Inspection and Responsibility
Buyers must physically inspect acceptable items and verify their condition, including battery health and compliance with Australian standards, before payment. Buyers are solely responsible for their decision to pay and accept all risks of purchasing without inspection, including issues with quality, battery performance, or functionality. An exception applies when buying from a registered Australian company (with a valid ABN) that provides a warranty and tax receipt, offering ACL protections (e.g., consumer guarantees). eRideList is not liable for issues from Buyers’ failure to inspect or verify.
6.4 Renter and EV Service User Responsibilities
Renters and Users arranging EV Services must:
- Use acceptable items or engage EV Services lawfully and per manufacturer or provider guidelines, including proper battery charging practices.
- Obtain required permits/licences (e.g., for road use or specific repairs, per state laws).
- Avoid misuse, neglect, or unauthorised operation of acceptable items or EV Services, including overloading batteries or modifying software.
- Report faults, damage, or EV Service issues (e.g., battery degradation, repair failures) to Owners or Service Providers promptly.
Non-compliance may lead to disputes or legal action between Users.
6.5 Disputes
Users are solely responsible for resolving disputes (e.g., damage, non-payment, cancellations, or EV Service quality, including battery-related issues), whether from on-platform or off-platform interactions. eRideList will not assist with or be liable for dispute outcomes. Users may pursue remedies in New South Wales courts, retaining evidence (e.g., photos, messages, receipts) to support claims, as advised in our April 2025 FAQs at
FAQs.
7. Privacy
We comply with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Our
Privacy Policy and
Cookie Policy detail how we collect, use, and protect your data, including provisions for users under 18. By using the Platform, you consent to these practices.
8. Intellectual Property
eRideList owns all Platform content (e.g., logos, software). Users grant us a royalty-free licence to use submitted content (e.g., listings, reviews) for Platform operation and promotion. Users must not infringe intellectual property or reproduce Platform content without consent. Report infringements via the
Contact Us form.
9. Liability and Indemnity
The Platform is provided “as is.” To the maximum extent permitted by law, eRideList is not liable for any costs, losses, or damages incurred by Users (e.g., from transactions, EV Services, or disputes), except for:
- Death or injury due to our negligence.
- Non-excludable consumer guarantees under the ACL (e.g., fit for purpose).
Users indemnify eRideList against claims arising from misuse, violations, or third-party disputes, per Australian law.
10. Miscellaneous
The following provisions apply:
- Governing Law: Australian law applies; disputes are subject to the jurisdiction of New South Wales courts.
- Entire Agreement: These Terms replace prior agreements.
- Severability: Invalid provisions do not affect others.
- Force Majeure: We are not liable for delays due to uncontrollable events (e.g., natural disasters), provided evidence is submitted.
