Terms and Conditions
Last updated 6 October 2026
1. Introduction
Welcome to eRideList. The Platform is operated by eRideList (ABN 14 218 299 030) ("we", "us", "our"). These Terms and Conditions ("Terms") govern your use of our website and services (together, the "Platform"), which advertises e-rides, electric vehicles (EVs), hybrid EVs and related services for members in Australia.
By accessing or using the Platform you agree to these Terms, to our Privacy Policy and to our Cookie Policy. If you do not agree, please do not use the Platform. Nothing in these Terms limits your rights under Australian law, including the Australian Consumer Law (ACL) and the Privacy Act 1988 (Cth).
2. Definitions
- Platform — the eRideList website and the features we provide through it.
- Member — any person or entity using the Platform, including buyers, sellers, hirers, service providers and visitors, whether or not they have an account.
- Owner — a Member listing an acceptable item for sale or hire.
- Buyer / Hirer — a Member buying or hiring an acceptable item.
- Service Provider — a Member offering Services.
- e-rides — personal mobility devices powered by an electric battery and designed to be ridden by a person. Examples include e-bikes, e-scooters, e-skateboards, e-foils and one-wheelers. Devices that are not ridden by a person, such as remote-controlled toys, are not permitted.
- EV (fully electric) — road vehicles powered entirely by an electric battery, with no internal combustion engine, and designed to be driven by a person, such as fully electric cars and vans. Vehicles that are not driven by a person are not permitted.
- PH-EV (plug-in hybrid) — road vehicles combining an electric battery and motor with an internal combustion engine, where the battery can be recharged from an external power source.
- H-EV (hybrid) — road vehicles combining an electric battery and motor with an internal combustion engine, where the battery is charged by the engine or by regenerative braking rather than from an external power source.
- Acceptable Items — items meeting the definitions of e-rides, EVs, PH-EVs or H-EVs. These are the only items that may be listed. EV, PH-EV and H-EV are the same labels used on the Post Ad form and the category buttons.
- Services — work offered in relation to Acceptable Items, including servicing, repairs, installation, inspection, part replacement and maintenance. Examples include EV wall charger installation, EV body repair, pre-purchase inspection, e-bike repair, battery maintenance and software updates.
3. Using the Platform
3.1 What eRideList is — and is not
eRideList is a free classifieds noticeboard. We give sellers, owners and service providers a place to advertise, and buyers and renters a place to find them, within their local area. That is the whole of our role.
- We are not a party to any sale, hire or service agreement. Every transaction is directly between the Members involved.
- We do not handle money. We take no payments, hold no deposits or funds in escrow, charge no commission, and offer no payment protection or buyer guarantee scheme.
- We do not own, inspect, test, store, transport, deliver or service anything advertised on the Platform.
- We have no control over whether a seller actually has an item, owns it, is entitled to sell it, or will deliver it.
Chats on the Platform are private between the Members in them. eRideList staff may open a chat only to investigate a report, complaint or dispute, suspected unlawful activity, or a lawful request from police, a regulator or a court, as described in our Privacy Policy. Members may communicate through Platform tools or directly, at their discretion. All communication, transactions and Services — whether arranged on or off the Platform — are at Members' own risk. For guidance on what to watch for, see our common scams and fake trades page.
3.2 What our review actually means
Listings are reviewed by a person before they appear. That review isnormally completed within 24 hours, though it may take longer at busy times. The review checks an ad against our content rules — that it is an acceptable item, is in the right category, is not obviously prohibited, fraudulent or unsafe, and contains the information we require.
Our review is not verification. We do not confirm that an ad is accurate, that an item is in the described condition, that the seller owns it or is entitled to sell it, that it is free of finance or encumbrances, that its battery is sound, that it is roadworthy, or that it is legal to use where you live. An ad appearing on eRideList is not an endorsement, recommendation or warranty by us. You must make your own enquiries before you buy, hire, or engage a Service Provider.
3.3 How ads work
- Posting an ad is free.
- An approved ad runs for 30 days. We email you a reminder about three days before it expires so you can renew it for another 30 days. Renewing does not change your ad, so it does not need another review.
- If it is not renewed, it expires and comes off the Platform. You can bring it back by editing and resubmitting it, which goes through review again.
- Editing a live or paused ad does not need another review; your changes go up straight away. We keep a record of what changed and may check edited ads. Editing an ad that was declined or removed sends it back for review, like a new ad.
- We may decline, remove, pause or ask you to change an ad that breaches these Terms or the law. Where we decline one, we tell you which rule it fell foul of — along with a note about your particular ad, where the reviewer has written one — so you can fix it and resubmit.
4. Things you must not do
Members must not:
- List items that are not acceptable items, or that you may not lawfully sell — including stolen goods, unsafe or recalled products, and non-compliant batteries or chargers.
- Post false, misleading, fraudulent or scam ads, or list items you do not have.
- Misrepresent the condition, battery health, ownership, availability, roadworthiness or price of an item, or your qualifications to perform Services.
- List items that exceed the legal power or speed limits that apply where they are to be used, or advertise a device as legal to ride somewhere it is not.
- Offer Services you are not licensed or qualified to perform where a licence or qualification is required.
- Post content that is defamatory, harassing, hateful, obscene, discriminatory, or that infringes someone else's copyright or trade marks.
- Abuse, threaten, intimidate or harass another Member, or use offensive language toward them — in Platform messages, in any email or phone contact that follows, or in person when meeting to inspect, collect, deliver or service an item.
- Publish another person's personal information without their consent.
- Send unsolicited commercial messages, or use contact details obtained here for marketing.
- Scrape, copy or bulk-download ads, or use bots to interact with the Platform.
- Interfere with the Platform's security, or try to access another Member's account.
Treat other Members with respect. Buyers, Owners, Hirers and Service Providers are all expected to deal with each other courteously — in messages sent through the Platform, in any contact that follows, and in person while a transaction or service is being arranged or carried out. Disagreeing about a price, an item or a service is normal and fine. Abuse, threats, slurs, discriminatory remarks and offensive language are not, and we do not accept them whichever side of a deal they come from.
Breaches may result in an ad being removed, an account being suspended or closed, and, where appropriate, a report to police or a regulator. You can report a breach using the "Report this ad" link or by emailing support@eridelist.com.au.
5. Your account
5.1 Eligibility
You must be at least 18 years old to hold an account, post an ad, or send messages through the Platform. Anyone may browse the public ads without an account.
By creating an account you confirm you meet this requirement. We may close an account where we reasonably believe the holder is under 18. If an item is bought or ridden by someone under 18, their parent or guardian is responsible for supervising that use and for any licence, permit or safety equipment the law requires.
5.2 Registration
- Give accurate registration details and keep them current.
- Keep your password confidential. You are responsible for what happens under your account unless it is used without your fault.
- One person or business per account; do not share, transfer or sell accounts.
- You may sign in with an email address and password, or with a Google or Facebook account. Where you use a third-party sign-in, that provider's own terms and privacy policy also apply to what they do with your information.
- Tell us promptly at support@eridelist.com.au if you think your account has been accessed by someone else.
5.3 Communications
By registering you consent to receiving service messages by email — ad approvals and rejections, expiry reminders, replies to your enquiries, and notices about these Terms. These are part of running your account and cannot be switched off while your account is open. Marketing emails, if we ever send any, are separate and you can unsubscribe from them at any time.
We use reasonable technical and organisational measures to protect your information, but no online service can guarantee absolute security. See our Privacy Policy for how we handle personal information.
5.4 Reviews
Members may leave a review after dealing with another Member. Reviews must be honest, based on a genuine dealing, fair, respectful and relevant.
A review you leave is public, but not under your name. The rating, your written comment, the date and which ad the trade was about are all visible to anyone who opens the reviewed Member's review list. Your name is not shown there. The Member you reviewed does see your name against it in the chat where you left it.
We may remove a review that is abusive, defamatory, off-topic, contains personal information, or was not based on a real dealing. We do not remove a review simply because it is negative or because the person reviewed has asked us to. We do not write reviews ourselves, pay for reviews, or offer any incentive in exchange for a favourable one.
By posting a review you give us a non-exclusive, royalty-free licence to display it on the Platform for as long as it remains posted.
5.5 Suspension and closing your account
You can ask us to close your account at any time by emailing support@eridelist.com.au. There is no self-service delete button — closures are handled by our support team, and we may retain records of your dealings for the period set out in our Privacy Policy. We may suspend or close an account that breaches these Terms or the law, or that puts other Members at risk. Except where the breach is serious, or where we are legally required to act immediately, we will tell you what the problem is and give you a fair chance to fix it first. If we close your account you can ask us to explain why, and you can complain to us about the decision.
6. Transactions and Services
6.1 Posting an item or a service
Owners and Service Providers must ensure that acceptable items are safe, functional and legally compliant, and that Services are performed competently and lawfully. Ads must be accurate, use photographs of the actual item, and disclose faults, damage, repairs, battery condition and range, and anything else a reasonable buyer would want to know.
Private sellers and business sellers
When you post an ad you choose one of five seller types: Private, Sole Trader, Business, Dealer or Broker. You must choose the one that is true. Selling repeatedly or for profit makes you a business, whatever you select. A sole trader is one person trading under their own name with no company. They must enter a valid ABN, and are still selling in trade and carries the full weight of the Australian Consumer Law.
Sole Trader, Business, Dealer and Broker sellers are acting in trade or commerce and carry the full weight of the Australian Consumer Law. If you sell as one of these you must:
- If you are a Business, Dealer or Broker, enter a valid, active ABN and your registered business or company name. Both are shown on your ad, and the name does not need to be a shop. Include any licence your state requires — including a motor dealer licence or LMCT number if you deal in vehicles.
- Honour the consumer guarantees. You cannot contract out of them: phrases such as "sold as is", "no refunds" or "no returns" do not remove a buyer's statutory rights and may themselves be misleading.
- Meet any state statutory used-vehicle warranty that applies to your sales.
- Not engage in misleading or deceptive conduct.
ABN badge
When an ad has an ABN, we check it against the Australian Business Register and show a badge. A green badge only means the ABN is valid and active. An amber badge means it is cancelled, not valid, or the business name on the ad did not match the register. The registered name is never shown. The check is refreshed about once a week. It does not prove that the seller is that business or is connected to it, and eRideList does not verify sellers. Buyers are fully responsible for checking the ABN against the seller's business name and the registered name, for example on ABN Lookup, before they pay or hand over anything. Sellers are responsible for entering an ABN that belongs to them. We never show a personal name from the register, only a registered business name.
Posting limits
To stop the site and our review queue being flooded, there is a limit on how many new ads one account can post in 24 hours, and on how many can be waiting for review at once. The limits are not a penalty and are not about any one person. They apply to everyone and are set by us, and we may change them from time to time. There is no limit on how many ads you can have live, and editing an ad does not count. If you need a higher limit, for example a dealer loading stock, ask us through the Contact Us page and we will usually raise it for genuine sellers. Posting many near-identical ads, or trying to get around the limits, is treated as spam and may lead to ads being removed or an account being restricted.
Vehicle ads
You must disclose, where it applies:
- Whether the vehicle has been written off, is on a written-off vehicle register, or has been repaired after a significant accident.
- Whether money is owed on it, or any security interest is registered against it.
- Its true odometer reading and registration status.
- Any inspection certificate your state requires for a sale. In Queensland a safety certificate is required and its number must appear in the advertisement. In Victoria a roadworthy certificate is required and is valid for 30 days. The ACT and Northern Territory require inspections for older vehicles. New South Wales, South Australia, Western Australia and Tasmania generally do not require an inspection to sell a registered light vehicle privately.
Sellers must also lodge a notice of disposal with their state road authority after a sale, within the period that state requires.
E-bike, e-scooter and battery ads
- State the motor power in watts and the top speed, accurately. These determine whether a device is legal to use, and in which state.
- Include the safety approval or certification marking for the device, battery and charger. New South Wales safety and information standards for e-micromobility products have been fully enforced since 1 February 2025, apply to second-hand sales and to products displayed for sale online, and carry substantial penalties. Our rules and battery safety page lists the accepted standards.
- Include the warning: "Before using this vehicle, check the applicable local laws relating to your intended use of the vehicle on roads and road related areas."
- Do not list recalled products. Check the national recalls register at productsafety.gov.au/recalls before advertising a used e-ride, battery or charger.
Importers and re-sellers
If you import an e-ride, battery or charger into Australia yourself — including parallel-imported, drop-shipped or bulk-purchased overseas stock — and the actual manufacturer has no place of business in Australia or cannot be identified, the Australian Consumer Law treats you as the deemed manufacturer. That carries the same product-safety and consumer-guarantee liability as the manufacturer itself, not the lighter obligations of an ordinary reseller. If this applies to you:
- Confirm the device, battery and charger meet the mandatory standards on our rules and battery safety page before you offer any unit for sale or hire, and keep your compliance and testing records — you may need to produce them.
- You cannot exclude or reduce this liability by labelling stock "imported", "parallel import", "grey import" or similar, and consumer guarantees apply regardless of that wording.
- Check the national recalls register at productsafety.gov.au/recalls before importing or re-listing a model, and withdraw any stock that is later recalled.
- Re-sellers and distributors who are not the importer still carry full responsibility, as a business seller, for the items and Services they list — see "Private sellers and business sellers" above.
This is a general summary to flag that importing carries extra legal weight, not a complete statement of your obligations as an importer. Seek your own legal advice before importing goods for resale.
6.2 Arranging a transaction or service
Members arrange sales, hire and Services directly, including payment, deposits and cancellation. These are agreements between Members; eRideList is not a party to them and does not hold or process any money.
- Hirers must return an item on time and in the same condition, including battery charge level.
- Members engaging a Service Provider should confirm their qualifications and licences, particularly for battery or software work.
- All parties are encouraged to record the condition of an item, or the scope of a service, with timestamped photographs or written records at the start and end.
6.3 WhatsApp and other off-platform contact
Some sellers choose to list WhatsApp as an additional Contact Channel on their ad, alongside eRideList Chat. eRideList Chat remains the default way to contact a seller and is always available — WhatsApp, where offered, is only ever an optional extra a buyer may choose to use instead or as well.
The same applies to you as a buyer: if you tick WhatsApp and save a phone number in your account settings, the seller in a chat you have already started can message you there too. It is offered only to someone you are already in a chat with, and you can withdraw it at any time by unticking WhatsApp or clearing the number in your account settings.
If you choose to continue a chat on WhatsApp or any other off-platform channel, that chat is entirely outside eRideList:
- We keep no record or copy of anything said on WhatsApp, and cannot retrieve or produce it later, including if a dispute arises.
- We do not send email or in-app notifications about WhatsApp messages, unlike eRideList Chat, where new messages trigger a notification.
- eRideList does not mediate or decide disputes between members on any channel (see 6.7 below) — that is unchanged by which channel you used. What WhatsApp does change is evidence: we cannot verify or confirm anything said there, so if you ever need to show what was agreed, your own WhatsApp chat history is what you'll be relying on, not a record held by us.
- The same safety guidance applies regardless of channel: never pay before inspecting the item, and see our Common Scams and Fake Trades guide for the warning signs to watch for, which are just as relevant on WhatsApp as anywhere else.
6.4 Inspect before you pay
You are buying from the seller, not from us. Before you hand over money:
- Inspect the item in person, or arrange an independent inspection.
- For a vehicle, run a PPSR search — it costs about $2 and tells you whether money is owed on the vehicle. If you buy an encumbered vehicle without searching, a financier may be able to repossess it from you.
- Check that an e-ride is legal to use where you intend to ride it, and that its battery and charger carry a recognised certification mark.
- Be wary of anyone who will not meet in person, pressures you to pay quickly, asks for payment by gift card, bank transfer to an unverified account or cryptocurrency, or offers a deal that seems too good. Report them to us — and see our common scams and fake trades page for how each of these actually plays out.
If you choose to pay without inspecting, you accept the risks of doing so. That choice does not, however, take away any right you have against the seller under the Australian Consumer Law or the general law.
6.5 Hirer and service customer responsibilities
Hirers and Members engaging Services must:
- Use the item, or engage the service, lawfully and in line with manufacturer or provider guidelines, including safe battery charging practice.
- Hold any permit or licence required for the use intended, under the law of the state or territory where the item is used.
- Avoid misuse, neglect, unauthorised operation, overloading batteries or unapproved modification of software or hardware.
- Report faults, damage or service problems to the Owner or Service Provider promptly.
6.6 Your rights under the Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
Buying from a business
The full consumer guarantees apply — the item must be of acceptable quality, match its description, and be fit for any purpose the seller said it was fit for. If it is not, your remedy is against that seller.
Buying from a private seller
Most consumer guarantees do not apply to a one-off sale between two individuals. There is no acceptable-quality guarantee, no fitness-for-purpose guarantee, and no cooling-off period.
But some guarantees still apply, even privately: the seller must have clear title to the item, must be able to give you undisturbed possession of it, and must disclose any undisclosed security over it. Fraud and misrepresentation remain unlawful in any sale.
6.7 Disputes and reporting a problem
Members are responsible for resolving disputes between themselves — damage, non-payment, cancellation, or the quality of an item or a Service. eRideList is not a party to those dealings and cannot decide them or award a remedy.
We do, however, act on reports. Every ad has a "Report this ad" link, and you can always email support@eridelist.com.au.
- We aim to remove or restrict access to ads for unsafe or recalled products within 2 business days of becoming aware of them.
- We aim to respond to a written complaint about defamatory or otherwise unlawful member content, and to take reasonable access-prevention steps where warranted, within 7 days.
- To help us act, tell us which ad, what is wrong with it, and how to reach you.
Keep your evidence — photographs, messages, receipts and records. If a dispute cannot be resolved directly, you can take it to your state or territory consumer affairs or fair trading body, to the relevant civil and administrative tribunal, or to a court. Conduct that may breach the Australian Consumer Law can be reported to the ACCC at accc.gov.au. Scams can be reported to Scamwatch.
7. Privacy
We handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Our Privacy Policy and Cookie Policy explain what we collect, why, who we share it with and how to access or correct it.
Account and ad data is stored in Australia (Supabase, AWS ap-southeast-2 Sydney region). Transactional email is sent through United States (Resend, transactional email delivery).
If you are not satisfied with how we have handled your personal information, tell us first at support@eridelist.com.au. You can also complain to the Office of the Australian Information Commissioner at oaic.gov.au.
8. Intellectual property and your content
We own or licence the Platform itself — its name, logo, design, text and software. You must not copy, reproduce or reuse it without our consent.
You keep ownership of everything you post. By posting it you give us a non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting and display your content on the Platform and in promotion of the Platform, for as long as your content remains on the Platform. That licence ends when your content is removed, except for copies already made in backups or where we must keep a record by law.
You confirm you have the right to grant that licence — for example, that you took the photographs or have permission to use them. If you believe content on the Platform infringes your copyright or trade mark, email support@eridelist.com.au with details of the ad and your claim.
9. Liability and indemnity
The Platform is provided free of charge and on an "as is" basis. We do not promise that it will be uninterrupted or error-free, and we are not responsible for the conduct of any Member, the accuracy of any ad, the condition, safety or legality of any item, the quality of any Service, or the outcome of any transaction arranged through the Platform.
Dealings between Members are their own. Every sale, hire and Service arranged through the Platform is an agreement between the Members involved, not with us. Those Members carry the responsibility and the risk for it — payment, the condition, safety, legality and description of an item, the standard of any Service, and any loss, damage, theft or injury arising from it. Meeting another Member, allowing an inspection or test ride, handing over an item or money, and riding, driving or using anything advertised here are all done at your own risk.
Our rules, safety and compliance content is for reference only. Our rules and battery safety page, the FAQ, the compliance and legality information shown against an ad, and any external link we provide, are a general guide only. We compile them in good faith from official sources at the time of writing, but laws, standards and penalties change, we may get something wrong, and we do not independently verify what any Seller, Owner or Service Provider declares about their item or Service. This content is not legal advice and is not a substitute for checking with the relevant government authority, a qualified tradesperson, or your own legal adviser. Sellers, buyers, Owners, renters and Service Providers each take full responsibility for the safety, condition and compliance of their own item or Service with the Australian Consumer Law and all applicable Commonwealth, state and territory regulations — that responsibility is theirs regardless of anything stated on the Platform.
Subject always to the paragraph below, you release us from any claim you may have against us arising out of a dispute between you and another Member, and you agree to pursue that dispute with them directly.
Nothing in these Terms excludes, restricts or modifies any liability that cannot be excluded, restricted or modified under the Australian Consumer Law or any other law. This includes liability for death or personal injury caused by our negligence, and the consumer guarantees that apply to the services we supply.
Where the law permits us to limit our liability for a service we supply, our liability is limited to resupplying that service or paying the cost of having it resupplied. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit or opportunity.
Indemnity. If a third party brings a claim against us because your content was unlawful, or because you breached these Terms or the law, you agree to cover the reasonable costs and losses we incur in dealing with that claim, to the extent it results from your act or omission. This does not apply to the extent the claim was caused by our own negligence or breach.
10. General
- Governing law. These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state — which means you may still bring proceedings in the courts or tribunal of the state or territory where you live.
- Entire agreement. These Terms, together with our Privacy Policy and Cookie Policy, are the whole agreement between you and us about the Platform.
- Severability. If part of these Terms is found unenforceable, that part is severed and the rest continues to apply.
- No waiver. If we do not enforce a right straight away, that does not mean we have given it up.
- Events outside our control. We are not liable for delay or failure caused by something genuinely beyond our reasonable control, such as a natural disaster or an outage at a service provider we depend on.
- Assignment. You may not transfer your account or your rights under these Terms. We may transfer ours if the Platform is sold, on notice to you, provided your rights are not reduced.
11. Contact us
Questions, complaints and reports go to support@eridelist.com.au, or through our contact form. We aim to acknowledge every message within 7 days. We handle everything by email and do not operate a phone line.
By using eRideList you agree to these Terms, our Privacy Policy and our Cookie Policy.
